Floriology Terms & Conditions

1. Deposit

1.1 In order to secure the date of your wedding with Floriology, a £100 booking deposit (the “Deposit”) is required. Until the Deposit has been received by Floriology we reserve the right to offer the proposed wedding date to another person.

1.2 The Deposit will be deducted from the amount set out in the “Quote” (being for the purposes of these terms and conditions, the Initial Quote (see clause 2.1 below), the Revised Quote (see clause 2.2) or the Final Quote (see clause 3.2) (as appropriate)). If after payment of the Deposit your weddingis cancelled for any reason or you decide not to use Floriology’s services,the Deposit is non-refundable. In relation to any postponement of your wedding, the return of the Deposit will be at the discretion of Floriology.

 

2. Initial Consultation

2.1 An initial consultation will be arranged to discuss the requirements for your wedding (the “Initial Consultation”). Following the Initial Consultation, Floriology will provide you with a detailed quote (the “Initial Quote”) for your approval, by way of e-mail, unless otherwise indicated.

2.2 If required, any amendments should be confirmed to Floriology(either in person, in writing or by telephone) and a revised Quote (the “Revised Quote”) will then be prepared and sent to you.

2.3 If you choose to accept the Initial Quote or Revised Quote (as appropriate), you should confirm your acceptance in writing to Floriology. In doing so you will (provided Floriology have also received payment of the Deposit), be deemed to have entered into a contract with Floriology and consequently you agree to be bound by Floriology’s terms and conditions  (the “Wedding Contract”).

3. Final Consultation

3.1 Once your wedding date is booked with Floriology, we will seek to contact you approximately 6 weeks before your wedding day to confirm you are satisfied with the arrangements as set out in the Initial Quote or Revised Quote (as appropriate) (the “Final Consultation”). This is to finalise the arrangements and discuss any furtherchanges you may wish to make.

3.2 If any changes are made to the wedding order as set out in the Initial Quote or Revised Quote (as appropriate),prior to, or during the Final Consultation these must be communicated to Floriology (either in person, in writing or by telephone).The relevant amendments will then be made and a further quote (the “Final Quote”) will be prepared and sent to you. Once you are satisfied with the quote you should confirm your acceptance in writing to Floriology.

3.3 Full payment of the amount as stated in the Quote, (minus the Deposit) is due 30 days before the wedding date. If payment is not received by this date, no further work will be undertaken and the Wedding Contract will be deemed terminated, with no further obligation on either side. Floriology will not be obliged to offer any compensation for any inconvenience caused and any relevant cancellation charges as set out in clause 6 will apply.

3.4 If any further changes to your wedding order as set out in the Quote are required after payment of the sum referred to in clause 3.3,Floriology will work with you to accommodate yourneeds where possible and will invoice you separately for any costs and expenses incurred.

4. Delivery and Set Up

4.1 Upon delivery of the flower arrangements and any hired items (the “Goods”) an authorised person appointed by you should inspect the quantities and quality of the Goods and sign for the Goods.  Any concerns about the Goods must be raised with Floriology at the time of the inspection and where possible Floriology will use its best endeavours to resolve any issues. Floriology accepts no responsibility for the Goods delivered after a signature, as referred to above, has been obtained.

4.2 Floriology strongly advise an authorised person appointed by you be present to inspect the Goods upon delivery. If Floriology are instructed to deliver the Goods and leave them at the stipulated delivery address without them being signed for, as referred to in clause 4.1 above, Floriology will accept no responsibility for any subsequent damage to the Goods delivered or for any discrepancies relating to the quality and/or quantity of the Goods delivered.

4.3 Charges for deliveryand/or collection of the Goods and any setup charges, where relevant, will be stated in the Quote.

4.4 Removal of all flowers from the venue is your responsibility, unless previously arranged and included in the Quote as a chargeable extra.

4.5 Please note that delivery times are approximate as outside influences (such as traffic and weather) cannot be controlled.

4.6 In relation to any items hired by you (such as vases or other decorative items), Floriology reserve the right to request the payment of a deposit to cover the value of the items (the “Hired Items Deposit”). The Hired Items Deposit will be included in the Quote and will be payable in accordance with the terms of clause 3.3. The Hired Items Deposit will be returned to you within 7 days of your wedding date, provided the hired items are returned to Floriology in the state and condition originally provided. The cost of any missing or damaged hired items(as set out in the Quote) will be deducted from the Hired Items Deposit before the remaining balance (if any) is returned.

5. Cancellation by Floriology

5.1 If through illness or for reasons beyond our control none of our florists are able to finish your wedding flowers Floriology will employ a free-lance florist or pass your order to an available florist who will work to our quoted prices.

5.2 If in the very unlikely case Floriology are unable to find an alternative florist you will be refunded in full.

5.3 Floriology will not be liable or responsible for any failure to perform or the delay in performance of any of our obligations that is caused by events outside of our reasonable control. Events outside our reasonable control include the following (but is not limited to) any fire, flood, explosion, accident, adverse weather conditions, traffic congestion, mechanical breakdown, obstruction of any private or public highway, riot, government act, act of war, terrorism, act of God, or from any industrial dispute or strike whatsoever. In the event of any failure to perform or the delay in performance of any of our obligations under the Wedding Contract (as a result of such events as described in this Clause 5.3) any monies already paid to Floriology by you in respect of the Goods and any work carried out by Floriology in accordance with the Wedding Contract up to and including the date of the relevant event will be non-refundable. It is therefore strongly advised that you have appropriate insurance in place to provide for failure to perform or any delay in performance by Floriology as a result of the events described in this Clause 5.3.

6. Cancellation by You

6.1 The Deposit is non-refundable following any cancellation by you of your wedding order once your wedding date is secured with Floriology.

6.2 50% of the amount stated in the Quote is non-refundable following any cancellation by you of your wedding order anytime between 30 and 7 days before your secured wedding date.

6.3 The full amountstated in the Quote is non-refundable following any cancellation by you of your wedding order within 7 days of your secured wedding date.

7. Additional Terms and Information

7.1 Prices quoted will take into consideration a premium for weddings occurring over the Valentine’s Day period, the Mother’s Day period and the Christmas period and any public/bank holiday.

7.2 All wedding consultations will be made by appointment only. The Initial Consultation and Final Consultation (whether in person or otherwise) are complimentary. We will be available for contact by phone and email at any stage to answer any reasonable questions and queries you may have relating to the Quote. However, Floriology reserve the right to charge a further fee for any services performed in addition to the above.

7.3 As fresh flowers and foliage are living products, there are occasions when particular varieties may be unavailable. Whilst every effort is made to source products accordingly, sometimes Floriology may be unable to obtain a particular type of flower. All fresh flowers and foliage are subject to availability and stringent quality checks, as such Floriology reserve the right to use a similar flower in place of the previously chosen flower as set out in the Quote.

7.4 Floriology’s liability for any losses suffered as a result of any breach of the Wedding Contract is limited to the supply of the Goods only. No responsibility will be accepted for any consequential lossand Floriology strongly advise that you ensure you have relevant insurance in this respect.

7.5 Mock bouquets can be made if required but will be made to the same standard as the real bouquet and using (taking in to account clause 7.3 above) the best available materials. As such they will be charged at the quoted price and must be paid for in advance and will be quoted for separately and will not form part of the Quote.

7.6 Any mock bouquets made for you, along with any designs, sketches and photographs of our work that Floriology allow you to view and/or take away with you are subject to copyright laws (The Copyright, Designs and Patents Act 1988) and therefore, you are not permitted to show them to, or allow them to be copied or used by any other florist or floral designer without the express consent of Floriology. If you choose not to use Floriology to provide your wedding flowers, any designs, sketches and photos must be returned to Floriology without being copied.

7.7 Flower arrangements delivered by Floriology may be photographed or recorded for use on Floriology’s promotional material (including its website and social media), unless specifically stated otherwise by you.

7.8 Where confirmation is required in writing, e-mails are deemed an acceptable form of communication.

7.9 Floriology reserve the right to supplement and amend these terms and conditions from time to time and will inform you of any relevant changes.

7.10 These terms and conditions are governed by English law.

7.11 A person who is not a party to the Wedding Contract shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Wedding Contract.

7.12 All prices in the Quote are in UK Pounds Sterling and are correct at time of viewing.

1. Event Quote and Event Deposit

1.1 Following initial discussions. Floriology will provide the client with a written quote (the "Event Quote"). The Event Quote (which will be deemed to include any subsequent ammendments agreed with the client) will be for 14 days from the date started in the Event Quote (unless otherwise stated).

1.2 In order to secure the services of Floriology for the event, a deposit of £100 of will be required (the "Event Deposit").

1.3 If the Event Deposit has not been paid within 14 days of the date stated in the Event Quote, Floriology reserve the right to take another booking on the date of the event.

1.4 If the client chooses to accept the Event Quote, the client should confirm its acceptance in writing to Floriology. In doing so the client will (provided Floriology have received payment of the Event Deposit) be deemed to have entered into a contract with Floriology and consenquently agrees to be bound by Floriology's terms and conditions (the "Event Contract")

1.5 The Event Deposit will be deducted from the total amount set out in the Event Quote (or any subsequent revised quote). If after payment of the Event Deposit the event is cancelled or the client decides not to use the services of Floriology, the Event Deposit is non-refundable. In relation to any postponement of the event, the return of the Event Deposit will be at the discretion of Floriology.

2. Payment

2.1 Payment of the full amount as stated in the Event Quote (or any subsequent revised quote)(minus the Event Deposit) is due 14 days before the date of the event (unless otherwise stated). If payment is not received by this date, no further work will be undertaken and the Event Contract will be deemed terminated, with no further obligation on either side. Floriology will not be obliged to offer any compensation for any inconvenience caused and any relevant cancellation charges as set out in clause 5 will apply.

2.2 If any further changes to the order, as set out in the Event Quote, are required after payment of the sum referred to in clause 2.1. Floriology will use reasonable endeavours to work with the client to accommodate its needs where possible and at Floriology’s discretion and will invoice the client separately for any costs and expenses incurred.

3. Delivery and Set-Up

3.1 Upon delivery of the flower arrangements and any hired items (the “Goods”) an authorised person appointed by the client should inspect the quantities and quality of the Goods and sign for the Goods. The cost of any missing or damaged hired items(as set out in the Event Quote) will be deducted from the Hired Items Deposit before the remaining balance (if any) is returned.

4. Cancellation by Floriology

In the event of any failure to perform or the delay in performance of any of Floriology’s obligations under the Event Contract (as a result of such events described in this Clause 4.3) any monies already paid to Floriology by the client in respect of the Goods and any work carried out by Floriology under the Event Contract up to and including the date of the relevant event will be non-refundable. It is therefore strongly advised that the client has appropriate insurance in place to provide for failure to perform or any delay in performance by Floriology as described in this Clause 4.3.

5. Cancellation by the Client

5.1 The Event Deposit is non-refundable following any cancellation by the client of its order once the event date is secured with Floriology.

5.2 50% of the amount stated in the Event Quote is non-refundable following any cancellation by the client of its order anytime between 14 and 7 days before the secured event date.

5.3 The full amount stated in the Event Quote is non-refundable following any cancellation by the client of its order within 7 days of the secured event date.

1. Regular Delivery Terms & Conditions

1.1 Following initial discussions, Floriology will issue a quote to the client (the “Flower Quote”).

1.2 If the client chooses to accept the Flower Quote, it will confirm its acceptance in writing to Floriology. In proceeding with the arrangement,the client is deemed to have entered into a contract with Floriology and consequently agrees to be bound by Floriology’s terms and conditions (the “Contract”).

1.3 From time to time factors outside of our control, such as inflation rates and delivery costs, may result in an increase to prices originally quoted. If this occurs Floriology will notify the client of any relevant changes as soon as reasonably practicable(for example where deliveries occur over the Valentine’s Day period, the Mother’s Day period and the Christmas period and any public/bank holiday.)

1.4 In addition to clause 1.3 above, Floriology reserve the right to periodically review the prices originally quoted as set out in the Flower Quote and will inform the client of any proposed changes as soon as reasonably practicable. If the client is not happy with the proposed changes they may terminate the Contract in accordance with clause 1.16 below.

1.5 Delivery dates may be subject to change, provided reasonable notification is given to the client by Floriology. If the client decides to change the delivery date notification must be provided to Floriology in writing at least 24 hours in advance of the original agreed date. If this is not possible, Floriology will use reasonable endeavours to accommodate the needs of the client but cannot guarantee its ability to do so.

1.6 The order is deemed to have been received by the client once the delivery arrives at the agreed location.

1.7 The client has the right to examine the flowers on arrival and must provide written notification to Floriology within 24 hours of any dissatisfaction in regard to the condition, quality, defects or grade of the flowers. Floriology have the option to replace the flowers delivered or refund the invoice price of the defective items.

1.8 Once the flowers have been delivered to the client and accepted by the client, no return of the flowers will be accepted by Floriology.

Whilst every effort is made to source products accordingly, sometimes we may be unable to obtain a particular type of flower. All fresh flowers and foliage are subject to availability and stringent quality checks, as such Floriology reserve the right to use a similar flower in place of the previously chosen flower as set out in the Flower Quote.

1.10 Payment terms are according to the invoice provided to the client by Floriology. In the event of late payment, Floriology reserve the right to cease deliveries of any flowers until any outstanding payment is received in full by Floriology.

1.11 Vases and containers that are supplied are on a loan basis only and at no stage are owned by the client, unless otherwise agreed.

1.12 If any vases or containers hired from Floriologyare damaged whilst in the client’s possession,the cost of replacing the relevant items will be charged to the client.

1.13 Floriology’s liability for any losses suffered as a result of any breach of the Contract is limited to the supply of the flowers and any hired vases or containers only. No responsibility will be accepted for any consequential lossand we strongly advise the client to ensure it has relevant insurance in this respect.

1.14 Flower arrangements delivered by Floriology may be photographed or recorded for use on Floriology’s promotional material (including its website and social media), unless specifically stated otherwise by the client.

1.15 The Contract will be on an ongoing basis until notice is provided, subject to clause 1.16 below.

1.16 The Contract for services can be terminated by either party at any stage following a minimum notice period of 14 days. Notice of termination must be provided in writing. Any deliveries previously scheduled to be made during the notice period will still be delivered and must be paid for by the client.

1.17 Where confirmation is required in writing, e-mails are deemed an acceptable form of communication.

1.18 Floriology reserve the right to supplement and amend these terms and conditions from time to time and we will inform the client of any relevant changes.

1.19 These terms and conditions are governed by English law.

1.20 A person who is not a party to the Contract shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Contract.

1.21 All prices in the Flower Quote are in UK Pounds Sterling and are correct at time of viewing.

1. Gift Vouchers
  1. Vouchers are valid for 12 months from purchase. The gift voucher expiration date will be stated on them and cannot be used after that date.

  2. Vouchers cannot be replaced if lost, stolen or destroyed.

  3. Vouchers cannot be refunded or exchanged for cash or other denominated “vouchers”.

  4. If an intended purchase is for a higher amount than the face value of the vouchers the difference can be made up with a further payment. If it is less, then change cannot be given.

  5. If the recipient of the voucher purchases an item(s)less than the face value of the voucher. The revised remaining balance will be manually inserted by a member of the Floriology Team and will be initialled by both them and the recipient to confirm the amount remaining on the voucher.
